These Terms of Service (“Terms”) apply to your use of onyxelectricfl.com and our online booking tools, and to requests for service from ONYX Electric LLC (“ONYX Electric,” “we,” “us,” or “our”). By using our website or booking service with us, you agree to these Terms. If you do not agree, please do not use the website.

1. About Us

2. Use of the Website

You may use our website to learn about our services, contact us, and request or book appointments. You agree not to misuse the site. This includes submitting false or fraudulent requests, interfering with how the site works, trying to gain unauthorized access, scraping it in bulk, or using it for any unlawful purpose.

3. Service Requests, Estimates, and Scheduling

• A request or booking you submit online, by phone, by text, or through a third-party platform is a request for service. An appointment is confirmed only when we confirm it with you.
• Prices on our website, in ads, or given over the phone are estimates. Your final scope and price are set out in a written estimate, proposal, or invoice. They may change if we find conditions on site that could not reasonably be seen beforehand, such as hidden damage, code violations, or panel or utility limitations. We will discuss any change with you before doing additional work.
• Written estimates are valid for the period stated on the estimate.
• Each job is governed by its written estimate, proposal, or invoice, together with these Terms. If they conflict, the written job document controls.

4. Customer Responsibilities

You agree to give us accurate information, give us safe access to the work area and the electrical panel, keep pets and children away from the work area, and tell us about any known hazards. You confirm that you own the property or have the owner’s authorization for the work.

5. Permits and Inspections

When the work requires a permit, we will obtain it and schedule the required inspections. Permit and inspection timing depends on the local authority. Permit fees are included in or listed on your estimate.

6. Customer-Supplied Equipment

ONYX Electric provides installation services. We do not sell equipment such as EV chargers or generators. When you supply equipment, you are responsible for buying it and for its suitability and condition, and its manufacturer warranty comes from the manufacturer or seller. We are not responsible for defects in equipment we did not supply.

7. Payment

Payment is due as stated in your estimate or invoice, and is due when the work is completed unless otherwise agreed in writing. Larger projects may require a deposit. We accept the payment methods listed on your invoice. Unpaid balances may be subject to collection and to any remedies available under Florida law, including lien rights.

8. Cancellations and Rescheduling

Please give us as much notice as possible if you need to cancel or reschedule. Any cancellation, trip, or deposit terms that apply to your job will be stated in your estimate or appointment confirmation.

9. Workmanship Warranty

We stand behind our work. Any workmanship warranty, including its length and terms, is stated on your estimate or invoice. The warranty does not cover damage caused by misuse, alterations or repairs by others, power surges, lightning, storms, flooding, or other events outside our control, or defects in materials or equipment we did not supply.

10. Communications and Text Messages

By giving us your phone number and email address, you agree that we may contact you about your request, appointment, estimate, invoice, and service by phone, email, and text message. We send transactional text messages only. We do not send marketing texts. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. Agreeing to receive texts is not a condition of buying any service. Calls may be recorded. See our Privacy Policy for details.

11. Reviews and Submissions

If you send us reviews, photos, or feedback, you give us permission to use them to provide service and, for public reviews, to display them in connection with our business. Please do not submit anything that is unlawful, misleading, or that infringes someone else’s rights.

12. Intellectual Property

The website and its content, including the ONYX Electric name, logo, text, photos, and design, belong to ONYX Electric LLC or its licensors and are protected by law. You may not copy, reproduce, or use them for commercial purposes without our written permission.

13. Third-Party Services

Our website may link to, or rely on, third-party services such as our online booking portal, scheduling and payment platforms, maps, and review sites. Their own terms and policies govern those services, and we are not responsible for their content or practices.

14. Disclaimer

The website is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the website, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be uninterrupted or error-free. This section does not limit any written warranty we give for work we perform.

15. Limitation of Liability

To the fullest extent permitted by law, ONYX Electric will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website. For any claim related to the website, our total liability will not exceed $100. For any claim related to services we perform, our total liability will not exceed the amount you paid for that service. Nothing in these Terms limits liability that cannot be limited under Florida law.

16. Indemnification

You agree to indemnify and hold ONYX Electric harmless from claims arising from your misuse of the website or your violation of these Terms.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Hillsborough County, Florida, and you consent to their jurisdiction. Before filing a claim, you agree to contact us and try in good faith to resolve the issue informally.
